[Joel Smith did land transactions in Tennessee with the Holland family, so Isabell Holland above is a good candidate.] ---------- From the age of the children on early Tennessee census records it appears Joel Smith & Lydia Davis married about 1814 in North Carolina. Joel Smith m. Liddia Braddy 9 Dec 1812 Rutherford Co. N.C. Bondsmen were Daniel Smith & 2nd BENJAMIN DAVIS. The librarian said bondsmen were relatives. The 1800 & 1810 N.C. census show a Daniel Smith & BENJAMIN DAVIS in Rutherford Co.,N.C. & they were older than Joel & Lydia - too old for brothers & the right age for Fathers. I feel this is too much a coincidence. There was no record of a Lydia Davis marriage to a Braddy, but I suspect they were only married a short time. Also their son Lewis C. Charles Durham Lemenel Durham BENJAMIN DAVIS Seal ---------- 1818 Rutherford County, North Carolina Deed Book 29 - 31 Page 434 This Indenture made this 14th day of October 1816 between Jesse Davis of the one part and BENJAMIN DAVIS of the other part both of the County of Rutherford and state of North Carolina that for and in consideration of the sum of one Hundred and Ninety Dollars to me in hand pd by BENJAMIN DAVIS the Ext and payment whereof is hereby acknowledged hath the day and Date above written, bargained Set cinneyne and confirm in full simple a certain tract or parcel of Land being and lying in the County of Rutherford and State aforesd situate and bounded as follows Beginning on a post Oak on the N bank of 2nd Broad River then No 70 Et 68 poles to a stake then Et 55 poles then Wt 120 poles to a pin area the River bank their with the Meadow of the River to the Beginning contrary 18 acres and a half he the same more or less with all advantages either natural or otherwise To have and whole the same to the use of the said BENJAMIN DAVIS his heirs and assigns forever and doth hereby and forever Warrant and Defend the said tract and parcel of Land from my self my heirs and assigns Exers and Adms and all claim or claims whatever unto the said BENJAMIN DAVIS his heirs and Assigns Exrs and Admin. Davis Seal September ye 2nd 1818 No. 140 mark ---------- 1818 Rutherford County, North Carolina Deed Book 29 - 31 Page 500 December the 27th 1818 ex205 This Indenture made this 14th day of September in the Year of our Lord 1818 between BENJAMIN DAVIS and Robert Baber Jnr both of the County of Rutherford and state of North Carolina, Witnesseth that the said BENJAMIN DAVIS for and in consideration of the sum of Five hundred Dollars to him in hand pd by the said Robert Baber the Rect payment whereof is hereby acknowledged at and before the signing, sealing and delivering of these presents that he the said BENJAMIN for himself his heirs Exrs Admrs doth hereby bargain sell conveyance confirm unto the said Robert his heirs and assigns a certain piece or parcel of Land Situate in the County aforsd and on both Sides of 2d Broad River Joining above the land whereon the widow Sarah Baber now lives being all the land that John Baber Decd Sold to sd BENJAMIN except 58 acres on the wt side of the River wherein Jesse Davis now lives Beginning at a post Oak on the Et bank of the River Earles Corners runs then down the Meanders of the River opposite the mouth of a small branch on the Wt side of the River that heads up in Joseph Baxters field being the first little branch below the one Jesse Davis lives on then crossing the River and up the said little branch with the Meanders to a Lowerwood on Babers old line a line of the land Jo Baxter lives on then with So line Et 46 holes to a Stake on the Et bank of the River thence Down the river as it meanders to a Hickory at the lower end of a small bottong against the upper end of an old field known by the name of Shafers old field then No 38 Et 5 pole to a Hickory then No 8 Et 36 poles to a Post Oak then No 42 Et 20 poles to a pine in Chas Hills line (formerly) then nearly Wt to the old Root corner then No 8 Et 150 poles to W P. Oak then No 80 Wt 50 poles too B. Gum on the Et edge of an old path then So 10 Wt about 20 poles to him a conditional corner made by Jesse Davis and Allen Rogers then a conditional line as is marked passing within a few steps of Spring on the So side to the Beginning Including the Improvements where the said BENJ DAVIS now lives containing by estimate 170 acres be the same more or less which said piece or parcel of land with all and every of its members natural or Artificial there unto belonging or in the best wise appertaining the sd BENJ for himself his heirs Exr and Adms doth herby Warrant and forever Defend free from the lawful claim of any person whatsoever unto the said Robert his heirs and assigns and In Testimony whereof the said BENJAMIN DAVIS hath hereunto Set his hand and seal the year and date above written.
