Clinton DeWitt Richbourg & Lela Ann Smith

History written by Daughter Quata DeWitt Richbourg Conaway.

CLINTON  DEWITT RICHBOURG was born on a farm in  Erath  Co., near Carlton, Texas, November 8, 1885.

On July 31, 1906, he married LELA ANN SMITH, the daughter of Benjamin Lewis Smith and Ruth Ann Gotcher.  LELA was born  Ninnie Lela on November 29, 1887, near Carlton in Erath, Co., but  later changed her name to LELA ANN.

The  wedding  took place at 4:00 a.m. in the parlor  of  the Carlton  Hotel which LELA's father owned and  operated,  and  in which  the  family  lived.  The early hour was set  so  that  the couple  could start early on a trip in a covered wagon with  Bert and  Mildred  Thomas, sister and brother-in-law  of CLINT.   The wedding  night  was spent at a camp ground in  Logan's  Gap  near Comanche.   This  was  a popular camping  place  in  those  days because  of a good well that was there.  The couple told  of  how the  water had been channeled through a Mesquite tree root  which was shaped like a deer head.  From there they went to Loraine and to Miles Station before returning home.

CLINT  brought  his  bride  back  from  this  covered  wagon honeymoon  to live for three months with his parents  in  Carlton while waiting to get possession of his father's 432 acre farm  in Hamilton  Co.,  near  Carlton.  CLINT and his  brother  Ben  were working  the farm together, and Ben was living on the farm  while having a house built in Carlton.  Clint and Ben made 52 bales  of cotton that year.

The  couple's  three children were born on this  farm.   The Birth  of  the third child, a boy, gave  Flood   McGrue  Richbourg great  joy.   F.  M., as  he was named, was the  first  and  only grandson  to have the Richbourg name.  Flood gave F. M.  $100.00, which at that time was considered a sizable gift.

About  this  time  during a summer revival  at  the  Baptist Church, CLINT was converted and joined the church, LELA had  been brought  up in the Methodist Church, and she tells that  how  she felt  led her to join the church with CLINT.  They were  baptized t  the same time, and brought their children up in  the  Baptist church.

In 1911 Flood traded the farm to I. J. Gibson and received a 100 acre farm in the trade.  CLINT bought the 100 acre farm  from his  father  and moved to it.  After living on the farm  for  one year he sold it to a Mr. Bird in 1912.     Upon  the  advice  of his father,  who  owned  an  $8,000.00 interest  in  Curbo  Mercantile Co. in Carlton,  CLINT  moved  to Carlton,  bought  a  $1,000.00 interest in the  store  and  began working in the store for $35.00 per month.  He also bought a  new home  near the school for $600.00.  He had to have a  well  dug--also a cellar.  The family's means of transportation was a  surry with  fringe on top, and a yellow horse that often balked.   Many times on the way to church the horse would balk, and CLINT  would get  out  and hit the horse across the front legs with  a  strap.  This would make him go.

In  1913  CLINT's father died.  Some time later  his  mother divided her Curbo stock between her eight children.  About  1915, CLINTON   and  his  brother-in-law,  Burt  Thomas  traded   their interests  in  the Curbo store and CLINTON's house in on  a  farm near  Lumpkin in Comanche Co.  CLINTON bought out Burt that  same year.

After trading their home, CLINT and family moved to a  small rent house on LELA's father's farm not far from Carlton and CLINT continued to work for Curbo.  After the summer months, the family moved back to town and rented a house.

Mr.  Curbo was not happy with the division of Flood's  stock in  his  store, and since CLINT, as administrator, had  played  a part  in  the division, on Jan. 1917, Mr. Curbo  told  CLINT  his services  were needed no longer.  CLINT could not go to his  farm because  it had already been rented, so he went to Hico  to  work for G. M. Carlton Bros., a general merchandise store in which his brother  Bill had an interest and was manager.  His salary  there was $65.00 per month.  CLINT boarded with a family in Hico by the name of Woods from January until school was out and he could move his family to Hico.  Soon after CLINT left Curbo's the firm  went broke,  and several of the Richbourg children lost what they  had in the firm.

During the years that followed, CLINT traded farms 3  times.  In 1943 he sold the last form for $1,800.  He worked for  Carlton Bros.  until 1949 when the firm sold and closed out  their  store and Bill Richbourg retired.

On Jun 3, 1949, CLINT bought a General Merchandise Store and house  in Clairette.  He sold his home in Hico to Mr. Couch.   On June  3, 1957, he sold his store and home in Clairette,  retired, and moved to Granbury, Texas, buying a home there.  This move was made to be near their daughters in Fort Worth.

At this writing in 1971, CLINT and LELA are still living and with  reasonably  good  health.  Recently  they  had  their  65th wedding anniversary, and on that day they watched astronauts take the  first  ride  on the moon.  Their 65 years  of  marriage  has spanned an age from the covered wagon to the moon buggy.

The  royalties  above  mentioned  shall be  (a)  on  oil,  a quantity equal to one-eighth of all produced and saved, the  same to  be delivered at the wells or to the credit of the  lessor  in the  pipe  line  to which the  wells may  be  connected;  (b)  on natural  gas,  at  the rate of two  hundred  dollars  per  annum, payable  quarterly, for each well producing gas exclusively,  and from  which gas is then being used or sold off the  premises,  it being understood that the lessor shall have the privilege, at the lessor's  own risk and expense, of making connections  and  suing gas from such wells free of charge for one dwelling on said land; (c) on gas produced from oil wells, when such gas is used or sold off  the premises, at the rate of ten dollars per annum for  each well  while the gas is being used or sold, and when such  gas  is used for the manufacture of gasoline there shall be an additional payment at the rate of ten dollars per annum for each well  while such  gas is being so used for the manufacture of  gasoline;  and (d)  on sulphur, at the rate of one dollar per ton for all  mined and  marketed  from said land.  But it is understood  and  agreed that  the lessee shall have the free use of oil, gas,  wood,  and water  from  said  land  for  all  purposes  of  development  and operation.
If operations for the drilling of an oil or gas well are not begun  on  said land on or before the first day of  April,  1919, this lease shall terminate as to both parties, unless the  lessee on  or before that date shall pay or tender to the lessor, or  to the  credit  of the lessor in the F & M State  Bank  at  Carlton, Texas,  (which  shall continue as the  depository  regardless  of changes  in  ownership of the land,) the sum of fifty  cents  per acre,  which payment or tender may be made by the check or  draft of the lessee, and, however made, shall operate to confer on  the lessee  the  privilege of deferring the time limit for  one  year from  said  date.   Thereafter,  in like  manner  and  upon  like payments or tenders of said amount, the time limit may be further deferred  for  additional  periods  of  one  year   successively, provided  always that this lease cannot be kept in force by  such payments  in  the  absence of drilling operations  for  a  longer period  than five years from the date last above set forth.   But nothing  in this paragraph contained shall obligate  the  lessee, against their wish or option to make any such payment or to drill or otherwise carry on operations hereunder.  And it is understood and expressly agreed that the consideration first recited in this lease,  the down cash payment, and the obligation of the  grantee contained in the next ensuing paragraph hereof, shall be held  to support and sustain, not only the privileges granted to the  date first written in this paragraph, namely, the date when this lease is  to terminate unless an additional payment or tender is  made, but  also the lessee's option of extending that period from  time to time and keeping this lease in force as aforesaid, as well  as any  and all other rights and privileges conferred on the  lessee by this instrument.
If during the period of this lease or the extensions of  the time limit for drilling and within five years from the date  last above set forth, and prior to the discovery of oil or gas on said leased  land, there shall be drilled on adjacent land and  within 200  feet  of any line of said leased land, a well  producing  as much  as 50 barrels of oil per day for thirty  consecutive  days, the  lessee will, with reasonable diligence, begin and  prosecute the  drilling of a well on said leased land in a faithful  effort to find and produce oil in paying quantities.
After  operations  for the drilling of an oil  or  gas  well hall  have  been  begun  on said leased land  it  shall  not  be necessary for the lessee to make any further payments in lieu  of drilling operations as provided in the second preceding paragraph hereof  in  order to keep this lease in force;  and  during  said period  of five years drilling operations may be suspended from time to time, without terminating this lease, provided the lessee shall  have  paid or tendered, or shall then pay or  tender,  the amount hereinbefore mentioned for the then current period of  six months,  including  the time of such  suspension,   and  provided further  that after such operations are so begun no such  payment or  tender  shall  be necessary when  the  operations  are  being carried  on  in good faith and the period of suspension  is  less than thirty days.
If  the lessee shall sink a well or shaft and discover  oil, gas  or  sulphur  in  paying quantities in  or  under  the  above described  land, then this lease, shall remain in full force  and effect  for ten years from such discovery, and as much longer  as oil,  gas  or  sulphur  shall be  produced  therefrom  in  paying quantities;  and  having  so discovered oil, gas  or  sulphur  in paying  quantities,  the  lessee shall be exempt  from  loss  for forfeiture  of  this  lease, in whole or in  part,  except  after judicial ascertainment that the lessee has failed to perform  its duty  and  discharge its obligations hereunder and  a  reasonable opportunity thereafter to prevent such a loss for forfeiture, and in the event of final loss or forfeiture there shall be  reserved to  the lessee each producing well or mine with 10 acres of  land surrounding the same to be designated by the lessee.
No well shall be drilled nearer than two hundred feet to any house or barn now on said land, unless by consent of the  lessor, and nothing herein contained shall deprive the lessor of the full use  and  enjoyment of said land subject to  the  privileges  and estate  hereby  granted,  and when requested by  the  lessor  the lessee shall bury its pipe lines so that they will not  interfere with cultivation.
If the interest owned by the lessor in said land is or shall prove  to  be less than the entire fee the royalties  and  moneys herein  provided for shall be delivered or paid to the lessor  in the proportion only that the interest of the lessor bears to  the entire fee.
If  the estate of either party hereto is  assigned--and  the privilege of assigning in whole or in part is expressly allowed--the  covenant hereon shall extend to the assigns  and  successive assigns,  but  no  change in the ownership of  the  land  or  the rentals or royalties, by purchase or otherwise, shall be  binding on the lessee until it shall have been furnished with notice  and proper evidence of such change.
