James Yarbrough

 

The Yarbrough Family History was written by Nathan Yarbrough for his granddaughter Pearl Yarbrough Hart. His mind was strong to the end:

The Yarbrough family in the U.S. descended from a few families who emigrated from Scotland to America in the early settlement of the colonies and settled in what is now Virginia. There they multiplies and scattered out into what is now Maryland, North Carolina, South Carolina, and Georgia. They had become very numerous at the time of the War for Independence. Many of them served in that war. This information came from the records of the war in 1834. We found that JAMES YARBROUGH, who was the grandfather of Nathan Yarbrough had received a land bounty in Franklin County, Georgia. The father of Nathan Yarbrough, Groves Yarbrough, lived on this land for forty years. He and his wife were buried on this land. They had seventeen children, all of whom lived to be grown men and women. JAMES YARBROUGH served under General George Washington for 7 years and was barefooted at Valley Forge during that desperate winter we read about in history. He and his family left North Carolina and went to Georgia a few years after the war to settle the land given him for his services in the war.

The Cherokee Indians were troublesome to the white settlers, forcing them to seek shelter from the cold winter in a fort. The Indians became very quiet in the spring (1792), so JAMES, with his oldest son, Charles, and Several others, went out of the fort to clear some land in order to plant vegetables and corn for bread. A small band of Indians came upon them and killed JAMES and his son. The family then moved to South Carolina where the mother had friends and connections where they remained until the children grew up and some of them married. One of JAMES YARBROUGH's daughters married a man by the name of Jess Bowden of Georgia. He was a member of the Bowden family who started the present town where Bowden College now is.

Judge Nathen Yarbrough was born March 1, 1810, in Franklin County, Georgia, on the land his grandfather obtained as a bounty in the Revolutionary war. He moved to Decatur, Georgia, in 1835 near where Atlanta now stands. In 1836 he went to Rome, Georgia, where he married Miss Margaret Lamkin in April, 1839. He was elected to the legislature from Floyd County, Georgia, in 1845. He had the town of Rome incorporated and was its first mayor and was the third post master [he was the third mayor - see below]. He held all the various offices of Floyd County including Sheriff of which positions he was efficient and faithful to every trust imposed upon him.

He moved to Texas in 1870, stopping at Hillsboro and the next year moved to Comanche where he resided until his death June 22, 1899. He was 89 years, 3 months, and 22 days old.

He had been a worthy mason fifty years. He joined the Baptist Church in 1858. He was a good citizen in all the walks of life. He raised one brother, one sister, and 9 children, four boys and five girls.

Abt the same time Brigade orders were handed to Me, a Letter from Captain Alexr. Reid was put into My hands informing Me that on 11th Inst. a Mr. JAMES YARBROUGH & his Son were killed by the Indians upon Cedar Creek about two miles above the big Shoals of the Oconee.

Capt. Reid adds that at the same time the account of the Murder reached his house, he was from home but that it is Certain the Murder was Committed, that the Indians were Tracked Some distance from the place, That from the Tracks the pursuers Supposed There were no more than three of them; that from the appearance of the deceased they (the pursuers) were of the opinion the Indians rushed on them & tomahawked them, for no other wounds were to be Seen nor were their Scalps taken.

From the current reports here there can be no doubt of the death of JAMES YARBROUGH and his Son -- but as retaliation was expected by the frontier people for the Indian killed last year, it has not caused the usual alarm among the Settlers and I have heard of none breaking as yet...

...I lately observed in one of Mr. Smith's publications that it has been said the two YARBROUGH's were killed by white people and by some others that they were killed by lightning - but it has been sufficiently proved by several people they were Killed with hatchets and one of their heads cut almost off... ...The land on which Groves lived in Franklin Co., Ga. was part of the ... allotted his father, JAMES YARBROUGH for Revolutionary War service...that JAMES YARBROUGH received 287 1/2 acres of land in Franklin County, Ga. for Revolutionary Services, Warrant 797, dated 17 September 1784 Lot 802. In Deed Book MMM, page 131 Franklin Co., Ga, dated 13 August 1816, recorded 30 September 1816, we find that Elizabeth Yarbrough, daughter of JAMES YARBROUGH, granted to Groves Yarbrough, both of Franklin Co., Ga. for $50.00 32 acres of land, her part of the above 287 1/2 acres granted JAMES YARBROUGH...entitled at his death as one of his legal heirs. (Note by Nelle M. Jenkins - From the above indenture we assume that JAMES YARBROUGH, at the time of his death had 9 heirs, as we have listed already.)

JAMES YARBROUGH was granted 287 1/2 acres of land in Franklin Co., Ga, out by Broad River and Paynes Creek - Lot 802 - Warrant 797, dated 17 September 1787. This was the land mentioned in Deed Book B part II, 1819-1826, page 205. The indenture made 20 August 1816, between George Williamson of Oglethorpe County, Georgia, and Henry Harden of Morgan County, Georgia, for 143 3/4 acres on middle fork of Broad River, being part of the tract of land now occupied by George Yarbrough [Williamson not Yarbrough] and the 1/2 of the 287 1/2 acre bounty of land granted to JAMES YARBROUGH to which the same George Williamson became entitled at the death of the said JAMES YARBROUGH by his intermarriage with Susannah Yarbrough and his having lawfully purchased and obtained the rights (of) Mary Patrick, John Yarbrough, Anderson Berry and Jeremiah Yarbrough, heirs of the said JAMES YARBROUGH. [Note by Nelle W. Jenkins - Elizabeth Yarbrough was not named as a legal heir in this indent. But she was mentioned as legal heir in the deed, dated 13 August 1816, to the 32 acres as her part of the 287 1/2 acres of land on middle prong of Broad River. Both indents were witnessed by Jack Lumpkin, and Yelverton Thaxton, Jr. (J.P. not Jr.).]

JAMES YARBROUGH received a warrant $1238 dated 16 June 1784 for 2871/2 acres of land in Washington County Georgia - page 264 - warrant #808 for 287 1/2 acres in Washington County Georgia on 8 September 1784. the JAMES YARBROUGH folder contains a grant of 250 acres of land under the act of 1781, signed Savannah, 2 February 1784 by Elijah Clark, Colonel, and duplicate #914 dated 25 March 1784 and says the land to be in the new counties of Franklin and Washington Counties. The council granted 287 1/2 acres in Washington County. Another certificate says that JAMES YARBROUGH was entitled as a private in the "Batt. of Minute Men for Defence of Georgia" on 3 June 1777, and at the time enlistment was not an inhabitant of the State, and had not been for 12 months, according, and further was in service at the time the Battalion was reduced by Resolve 1 March 1778, signed by James Jack, Colonel, at Augusta on 24 April 1784.

[JAMES YARBROUGH of that day and time - and even a century after - did mention all their children in wills if they had already received a share of property - as perhaps was the case with Groves, who helped settle the estate of his father, who died intestate.]

Jaramiah Yarbrough, in Deed Book TTT, 1812-1814 page 137 Franklin County, Georgia - recorded 4 December 1813 - Deed made by Jaramiah (Jeremiah) Yarbrough of Oglethorpe County, Georgia to George Williamson of Oglethorpe County Georgia for $100.00 for 33 acres, his part of land, his part as legatee of JAMES YARBROUGH, deceased, of Franklin County, Georgia. Extract of Scriven Co., Georgia Marriages page 52 - Jeremiah Yarborough married Nancy Smith 4 March 1825.

Mr. Robert Neville Mann of Cedar Bluff, Ala. is descendant of George Williamson born between 1760 and 1770 in Virginia, and Susannah Yarborough who was born between 1770 and 1780 in Georgia - daughter of the Rev. soldier JAMES YARBROUGH...They died in Cherokee County, Alabama between 1840 and 1850...

State of Georgia This Indenture made this the twentieth day of Franklin County May in the year of our Lord one thousand Eight hundred and Eighteen between Joshua Yarbrough of the county of Oglethorpe and situate aforesaid of the one part and Groves Yarbrough of the county of Franklin and State aforesaid of the this part witnesseth that the said Joshua Yarbrough hath for and in consideration of the sum of Fifty Dollars to him in hand paid as the said Groves Yarbrough bargained sold released conveyed and confirmed unto him the said Groves Yarbrough a certain tract parcel piece or moiety of land situate lying and being in the County of Franklin & State aforesaid on the middle prong of Broad River adjoining Lands of Stephen Chatham and James Martin containing Thirty two acres be the same more or less it being his part of a two hundred eighty seven & a half acre tract of land granted to JAMES YARBROUGH & to which he became intitled at his death as one of his legal heirs and the said Joshua Yarbrough doth by these presents warrant and forever defend the right and title of the aforesaid piece or parcel of land with all and singularly the right members and appurtenances thereunto belonging or in any wise appertaining from himself heirs executors administrators and assigns and all and every other person or persons whatsoever claim by or through him unto the said Groves Yarbrough his heirs executors administrators and assigns forever In witness whereof I have hereunto set my hand and affixed my seal the day and date first above written Signed Sealed and delivered in presence of

Carson acting Justice of the Inferior Court and being Duly saith that he saw Joshua Yarbrough Sign Seal and deliver this deed of conveyance and that T. W. Bragg was also a subscribing witness together with him self sworn to this 29th February 1820

Georgia This Indenture made this twentieth day of August in the year of our Lord Eighteen hundred and sixteen between George Williamson of the County of Oglethorpe and state aforesaid of the one part and Henry Hardin of the county of Morgan and state aforesaid of the other part. Witnesseth that the said George Williamson hath for and in consideration of the sum of five hundred dollars to him in hand hath bargained and sold unto him the said Henry Hardin a certain tract or parcel of land situate lying and being in the county of Franklin and state aforesaid in the middle fork of Broad River containing one hundred forty three and three fourths acres be the same more or less it being a part of the tract of land now occupied by Groves Yarbrough and the one half of two hundred Eighty seven and a half acres bounty of land granted to JAMES YARBROUGH to which the said George Williamson became entitled at the death of said JAMES YARBROUGH by his intermarriage with Susannah Yarbrough and having lawfully purchased and obtained at the rights Mary Patrick, John Yarbrough, Anderson Berry & Jeremiah Yarbrough heirs of said JAMES YARBROUGH and the said George Williamson doth by these presents warrant and forever defend the right and title of the aforesaid land unto him the said Henry Hardin from the claim or claims of the aforesaid himself his heirs his executor, administrators and assigns and all and every other person or persons whatsoever claiming ? him and the said George Williamson doth by these presents make an ? quit claim for himself the before mentioned heirs and heirs and assigns forever and no further unto him the said Henry Hardin his heirs and assigns forever.
