Doyle From the age of the children on early Tennessee census records it appears JOEL SMITH and LYDIA DAVIS married about 1814 in North Carolina. The librarian said bondsmen were relatives & the early N.C. census records show Daniel & Benjamin the age of fathers rather than brothers. For this reason it is believed this is our JOEL SMITH & LYDIA DAVIS & that Lydia had previously been married for a short time to a Mr. Braddy. Their son Lewis named one of his sons Daniel & another Benjamin. ---------- JOEL died in Humphreys Co. July 1849 of liver complaint. His will was proven August 1849 - Court minutes #2. Carlton believes JOEL & LYDIA's daughter Manervia to be the same Manervia Jane Smith Allison that married his gggrandfather, James C. Carlton. She named her daughter Lydia. She and her husband are living next to Brison Smith (son of JOEL & LYDIA) on the 1850 census in Humphreys County, Tennessee and she followed the Smith clan to White County, Arkansas by 1860 and then on to Texas. (Deed Book I, pages 530-1) [In Rutherford Co., NC where JOEL & LYDIA were married, a Benjamin Davis (probably LYDIA's Dad) married an Isabell Holland 6 Feb 1776. This could be LYDIA's mother & the B. F. Holland above could be a relative. There is granted by the said State of Tennessee unto JOEL SMITH assign of the said Thomas Polk. A certain tract or parcel of land containing one hundred and sixty acres of survey bearing date of the 15th day of February 1821 Lying in the Eighth District in Hickman County on Cain Creek in Range seven and eight. Section three and bounded as follows to wit. Beginning sixty poles West of a point on the Range line eight hundred poles north of the south East Corner of section five in Range Eight at an elm sapling and runs East crossing Cain Creek at one hundred and twenty seven poles in all two hundred twenty-six and fourteen poles to a popular on the side of a ridge, thence south crossing the creek at 50 poles in all one hundred thirteen and three with poles to a plumb bush and elm sapling thence west two hundred twenty six and fourteen poles to a sugar tree and small hickory thence north to the Beginning with the hereditaments and appurtenances to have and to hold the said tract or parcel of land with its appurtenances to the said JOEL SMITH and his heirs forever in witness whereof William Carroll Governor of the State of Tennessee hath herewith set his hand and caused the Great Seal to be affixed at Nashville on the 8th day of April in the year of our Lord one thousand Eight hundred and thirty four and of the independence of the United States the fifty Eighth. F. Holand of the state and county aforesaid of the other part, witnesseth that for and in consideration of the sum of three hundred dollars to them the said JOEL & DICY SMITH in hand paid at and before the delivery of these presents by the said B. F. Holland the receipt of which is here by acknowledged and the above JOEL & DICY SMITH hath bargained and sold to the aforesaid B. F. Holland a certain tract piece or parcel of land the state and county aforesaid on Tract Creek of Tennessee River, the place where as B. F. Holland now lives containing one hundred and twenty one acres be the same more or less. Beginning and running as follows (to wit Beginning at a ?bench the North East corner of a tract of land of one hundred and sixty acres that Henry Stephens has heretofore lived on and running west 11 degrees North two hundred and forty three poles to a stake. Thence North forty poles to a post oak Thence East Two hundred and Thirty poles to a hickory, Thence south one hundred and fifteen poles to the beginning which said piece or parcel of land the aforesaid JOEL & DICY SMITH doth forever warrant and defend with all its appurtenances and hereditaments there unto belonging to the said B. F. Holland & his heirs and assigns forever from them selves their heirs & assigns or any other person or persons what ever claiming the same. State of Tennessee Humphreys County Personally appeared before me C. E. Harris Clerk of the county court of said county lewis Yeats & Dessy H. White subscribing witnesses to the within deed of conveyance who after being duly sworn depose and say they were personally acquainted with Joel Smith the bargainer to the within deed of conveyance of 121 acres of land and that they saw him sign seal and acknowledge the same to be his act and deed to B. F. Holland for the purposes their in contained given under my hand at office this 13th Aug 1849 and also personally appeared before me DICY SMITH the bargainer to the land as above with whom I am personally acquainted and acknowledged that she Executed the same to B. State of Tennessee Humphreys County Registers office Sept 19th 1849 Then was the within deed of conveyance from JOEL & DICY SMITH to B. F. Holland with the certificates then all duly Registered in said office in Book T. Pages 530 - 531 for registration Sept 19th 1849 T. M. and noted in notebook A page 86 R. T. Mclrary Regr ---------- Humphreys County, Tennessee 1849 Letters of Testament & Will Roll No. 10 Book G Page 232 & 233 State of Tennessee At a County Court began and held for the County of Humphreys in the first Monday it being the 6th day of August 1849. Present and presiding worshipful Albert Warren, Urbane Harris & Whidbea White Esqr Justices etc. at which the following proceedings were had to wit. A paper purporting to be the last will and testament of JOEL SMITH deceased was produced in open court and the due execution thereof proven by the oaths of H. Hillorable & William T. Jones subscribing witnesses then to and there upon Whidbea White who was the life executor to said Last Will and testament appeared in open court together with C. E. Harris & Urbane Harris his security then to and entered into and acknowledged therein bond in open court in the sum of five hundred dollars conditioned as the law executes. It is ordered by the court that letters testamentary open to the said W. White in the Estate of JOEL SMITH decd.
State of Tennessee Humphreys County Court August term 1849. Whereas it appears to the Court here that JOEL SMITH late of said County is dead and left a written will and testament in which Whidbea White is left Executor and he having been qualified and given bond as such then on to an and empower you the said Whidbea White into and after all and singular the goods & Chattles rights and credits of the said JOEL SMITH and the same unto your possession take whenever the same may be found and a true and perfect inventory then of to make and return unto our county court within ninety days from the date of this presents and all the Just debts of the said deceased to pay and also will and truly to pay and deliver all the legacies contained and specified in said testament as far as the said goods Chattels & credits will thereunto catered and the law changes Witness E. State of Tennessee Humphreys County Court Clerk's office August the 10th 1849 there was the auth Letters testamentary Granted to Whidbea White on the of JOEL SMITH duly recorded in said office in Book G. pages 251 & 252 C. E. Harris Clerk In the name of God Amen. I JOEL SMITH being weak and feeble in body, but sound in mind and memory and knowing that there is a time appointed for all men to die do make and publish this my last will and testament hereby revoking and making void all other wills by me at any time made. First I direct that my funeral expenses and all my just debts be paid as soon as possible out of any money I may die possessed of or may first come into the hands of my executor. Secondly I give and bequeath to my dear beloved wife DICY SMITH and my dear beloved Daughters Sarah Ann Smith and Joanna Smith all the benefits arising from my plantation or horses, hogs, cattle and all other stock I have together with all my household appurtenances during my dear beloved wife's natural life. And at her death to be equally divided between my dear beloved daughters Sarah Ann Smith and Joanna Smith with the exception of two fillys I have given to my dear beloved Daughters Manerva Smith and Caroline Smith. Thirdly I give and bequeath unto my dear beloved children Brison Smith, Mary Holland, John R. Smith, William Smith, James Smith, Lewis Smith, Manerva Smith and Caroline Smith a certain Judgement obtained in circuit Court of Perry County against L. H. Kimble for an un sum to all or any portion of said Judgement being collected to be equally divided between the above named children. Lastly I nominate and appoint my trusty friend Whidbea White my executor to this my last will and testament. This was the last will & testament of Joel Smith deceased with the proceedings of the court there on duly recorded in said office in Book G pages 252 & 253 C. E. I find him charged on settlement made with JOEL SMITH decd. who was the former guardian for Felix, Samuel H. and Nancy Ann McCastand minor orphans heirs of Isaac McCastand decd & upon - as follows to wit. I find him charged on settlement made with JOEL SMITH for my guardian etc. made on the 27th April 1849 with the sum of thirteen hundred and twenty nine dollars 69 cents $1,329.69 Interest on the above for four months 26.59 1/4 --------- $1,356.28 1/4 I find the Executor entitled to the following credits to wit. Paid clerks fee for making & recording this settlement 1.37 1/2 I allow the Executor for his trouble 1.50 --------- $ 2.87 1/2 Subtract two dollars 87 1/2 cents from thirteen hundred and fifty six 28 1/2 cents will leave in the hands of the Executor the sum of thirteen hundred & fifty three dollars 41 Cents $1,353.41. For which the said W. White produces the receipt of C. E. Harris & Eli White the present guardians for the above named children in full for the above named sum of $1,353.41 all of which is respectfully This 3rd day of September 1849 C. E.
