TOOLE, EDWARD m. Mary Holland 26 Sept 1764 Bondsman Jeraldus Toole Witness John Johnston ---------- Deed Book I page 24-5 Bertie Co., N.C. 1758 To all people to whom these presents shall come Greeting Etc. Know ye that I Edward Tool Senr of Bertie county in North Carolina in his Majesties Province etc. Do give and grant to my Son EDWARD TOOL JUNR a tract of land and Plantation Situate and Lying and being in Bertie County Two hundred acres of land and plantation only reserving to myself a Right and privilege of the land and Timber to be the same more or less and bounded as followeth Beginning at a Hickory Needham Bryan's corner, thence along his line to his other corner a white oak thence along Mathew Turner's to a Branch Isaac Harrells line thence down the said Branch to Isaac Harrells corner a live Oak thence along his line to the other corner in Caleb Spiveys line to Theophilus Williams line, thence along his line to the first station. To have and to hold the said given and granted premises with all the appurtenances privileges commodities to the same belonging or in any wise appertaining to him the said EDWARD TOOL JUNR his heirs and assigns forever to his and this only proper use benefit and behoof forever And I the said Edward Tool Senr for me my heirs Exors and admors do Covenant promise and grant to and with the said EDWARD TOOL JUNR his heirs and assigns the above granted premises and am lawfully seized and possessed of the same in my own proper right as a good perfect and absolute Estate of Inheritance in Fee simple and have in myself good right full power and lawful authority to grant bargain sell convey and confirm the said granted premises and that the said EDWARD TOOLE JUNR his heirs shall and may from time to time and at all times forever hereafter by force and virtue of these presents lawfully peacefully and quietly have hold use occupy possess and enjoy the said demised and granted premises with the appurtenances free and clear and freely and clearly acquitted Exonerated and discharged of and from all and all manner former or other gifts grants bargains, sales leases, mortgages wills entails Joyntures Dowers Judgments Execution Incumbrances and Extents and Furthermore I the said Edward Toole Senr for myself my heirs Exors and admrs do covenant and engage the above Devised to him the said EDWARD TOOLE JUNR his heirs and assigns against the lawful claims or demands of any person or persons whatsoever forever hereafter to Warrant secure and defend In Witness whereof I set hand and fix my seal this 23d of January 1758 Edward Toole SEAL Signed Sealed and delivered in the presence of John Harrell, James Abington Bertie County J January Court 1758. The above deed of gift was acknowledged in open court in due form of law and on motion was ordered to be registered Test Benjn Wynns Cler Cur ---------- 1772 Will of EDWARD TOOL Bertie Co., North Carolina In the name of God Amen, I EDWARD TOOL of the County of Bertie being very sick & weak in Body but of perfect and sound mind & memory Thanks be to God, Calling unto mind the mortality of my Body and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament that is to say principally and first of all I give and recommend my soul to God that gave it and my Body I recommend to the Earth to be buried in a Decent-Christian Burial at the Discretion of my Executors. And touching such worldly Estate where with it hath pleas'd to Bless me with I give devise & Dispose of the same in the following manner & form. First unto my well beloved wife the use of the Land & plantation whereon I now live during her natural life or widowhood. I also give unto her my well belov'd wife MARY Eight head of Cattle and one Halfe of my sheep & all what is left of what formerly belonged to my said wife before I married her and one small Trunk. Item I give & Bequeath to my son Jarldus Tool all my monably except one cow & calfe which I give to my son Jonathan Tool and I also give to my son Jonathan Tool one message or Tract of Land binding on David Harules line containing one Hundred & Thirteen acres be the same more or less and one feather bed and likewise I give unto my son Jaraldus one feather bed and one Rug & two trunks & one chest & one Tea Kettle. Item I give & bequeath all my Land & Plantations that I have not given to my son David Tool after the Death or marriage of my wife MARY I also give unto my well belov'd wife MARY all my corn and Wheate that is already filled in the Flour & I leave all the rest of my Estate that I have not given in Legacies to be Equally divided amgst all my children at my Death and last of all I make ordain & constitute and appoint at my Death and last of all I make ordain & constitute and appoint my son Jaraldus Tool & Josiah Harrull my Executors to this my last will & testament & I do hereby utterly disallow, Revoke & Diva all & every other Testaments wills & Legacies Bequeaths & by me in any way before made Ratifying this & no other to be my last will & testament.
