Benjamin Lewis Smith & Ruth Ann Gotcher

 

BENJAMIN LEWIS SMITH was born February 14, 1862, in White Co., Arkansas, in the vicinity of Searcy. At that time his father was engaged in the tanning business. BEN was the last of 6 children born to Lewis Comer Smith and Melvina D. Parker. Ten months after his birth, his mother died. Two months after her death BEN's father married Zenobia Kirkland who gave the children the love of an own mother.

As a young boy, BEN came to Texas in 1870 with his parents when they settled in McLennan Co. In 1876 he moved to Hamilton Co. near Carlton as his parents made the move to the new location. Here BEN married RUTH ANN GOTCHER born July 15, 1867, her father being John Gotcher, and he lived most of the remainder of his life in and around Carlton, Texas.

At one time BEN moved his family to a farm near Miles Station in Runnels Co. After a short stay on the farm where the girls and ANN all had the measles, he bought a hotel in Miles Station. There was a large building program going on at that time, and 32 carpenters boarded at the hotel. ANN became ill, having a very bad cough. Even though Ann felt that her condition was caused from lack of care when she had the measles, the doctor diagnosed her illness as galloping consumption, and said she had only a short time to live, so BEN sold out and returned to Carlton, to be near his family. He bought land west of Carlton, but after ANN recovered and the children were teen-agers BEN bought the Carlton Hotel. Later he sold and bought land south of Carlton. This land was later traded for a patch of land and house in Carlton where they lived until ANN's death November 17, 1942. There they had a few pigs and a cow or two, and a large vegetable garden. BEN contracted for the dray business from Hico to Carlton using a wagon and team for transportation. He continued in this business until retirement.

The grandchildren have priceless memories of these wonderful grandparents. They were good religious people, highly respected by those who knew them. The grandchildren looked forward to visits with them. Seldom was the Crock Cookie jar found empty of tea cakes, and usually there was a loaf of home made bread on the pantry table wrapped carefully in a dish towel. The old fashioned Crock churn with the wooden dash beat out many pounds of yellow sweet butter. ANN had regular butter customers as long as she was able to churn the cream.

BEN lived 10 years after ANN's death. He divided his time between his three daughters, but he considered Moda's home his permanent home. He died in his room there, February 8, 1952, and was buried in the Carlton Cemetery beside ANN. His death came five days before he was to be 90 years old.

Their daughter Lela Ann was named Ninnie Lela as she is shown on the Census records, but she changed her name since she didn't like Ninnie.

SMITH 114 acres of land fully described in Deed to which reference is hereby made retaining therein a Vendor's Lien securing payment of Four Hundred Dollars, for which said B. L. SMITH executed two promissory notes as follows:1st Note for Amount of $200. Due Nov. 1, 1896 2d Note for amount of $200. Due Nov. 1, 1897each bearing interest from date at the rate of 10% per annum and payable to the order of L. C. Smith and Whereas said B. L. SMITH has paid the said notes in full satisfaction of said incumbrance Now Therefore I L. C. Richbourg as follows: Two Hundred dollars cash the receipt of which is hereby acknowledged and the concellation and surrend__ to us two vendor lien notes for $42.50 each due on or before Jan 1 1922 & 1923 respectively, Said notes was executed by B. L. SMITH in favor of M. E. Richbourg and dated Jan 20 1921 and bear interest at the Rate of 8% from date. Interest payable annually at Carlton Texas, and Provide for the usual 10% for Attorneys fee if collected by Suit.Have granted sold and conveyed, and by these presents do grant, sell and convey, unto the said M. E. Richbourg of the County of Hamilton, State of Texas, all that certain Lot or parcel of land situated in the Town of Carlton, Hamilton County, Texas a part of the Richbourg Addition to the town of Carlton and described as follows, Beginning at the N. E. Corner of Lot in Block C for the N. W. Corner of this lot Thence W. with South side of Stephenville street 140 feet to N.E. Corner Lot 1, deeded to Simmons College, Thence South with said Simmon College log to the S.W. Corner of this lot, Thence E. with north line of Alley 140 feet for the S.E. Corner this lot. Thence North 140 feet to the place of beginning, Being Lot No. 2, Block C. Second Tract: Beginning at the N.E. Corner of Lot No. 3 Block C, Thence South with east side Houston Street, 263-4 feet the North side Comanche & Meridian Public Road, Thence East 100 feet to West side R. Road Right of way for corner this lot. Thence North easterly direction with West of said R. Road line 190 feet to corner. Thence East 164 to E. line R. Road right of way for cor. Thence N. with West line of said R. Road line to Lot 3 Block F 215 feet to Alley N. E. Cor this lot. Thence W. with S. side Alley to beginning; Beginning at the S. E. Corner lot 3, B. F. for corn on W. line Rail road line, Thence N. with said R. R. line 295 feet th. N.E. Cor this lot Thence W. with S. line of alley 213 feet N. E. cor this lot thence S. with line of lot 3, B. c 215 feet to the beginning, being lots No. 2 & 3 Block C., Lot No. 3 Block F, Richbourg Addition to Carlton Texas. To Have and to hold the above described premises together with all and singular the rights and appurtenances thereto in any wise belonging unto the said M. E. Richbourg and her heirs and assigns forever and we do hereby bind ourselves and heirs, executors and administrators to Warrant and Forever Defend, all and singular the said premises unto the said M. E. Richbourg, her heirs and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof.
